Can NRIs in the USA Buy Property in India?

Yes. Non-Resident Indians residing anywhere in the USA — whether on an H1B, L1, Green Card, or OCI status — can freely purchase residential and commercial property in India. Under the Foreign Exchange Management Act (FEMA), no special permission from the Reserve Bank of India (RBI) is required for residential or commercial property purchases.

However, NRIs cannot purchase agricultural land, farmhouses, or plantation properties in India.

Funding the purchase through an Indian home loan is fully permitted. Repayment must be made through your NRE or NRO account — transfers directly from your USA bank account (traveller’s cheques or foreign currency cash brought to India) are not permitted for EMI repayment.

Funding the purchase through an Indian bank home loan is also fully permitted. EMIs can be paid via inward remittances from your USA account or from your NRE / NRO account balance maintained in India.
